1. Who we are and what we do

Apply-ED provides tools and guidance to help families prepare and organise home education registration materials (for example, plans, checklists, and drafts).

We are a small family-run service created after going through the process ourselves. We aim to be helpful, practical, and fair.

2. Important disclaimer (please read)

  • Not a regulator or a school. We are not a government authority, not a school, and not a registered training organisation (RTO).
  • Not legal advice. Information on Apply-ED is general and is not legal advice.
  • No guarantee of approval. Home education requirements vary by state/territory and change over time. Using Apply-ED does not guarantee registration approval or any specific outcome.
  • You must check and decide. You are responsible for reviewing, editing, and confirming anything produced using Apply-ED before you submit it to an authority.

3. eligibility and accounts

  • You must be at least 18 years old and able to enter a contract to use paid features.
  • You agree to provide accurate information and keep your login details secure.
  • You are responsible for activity on your account.

4. What we collect (data minimisation)

We aim to collect and store the minimum personal information needed to provide the service.

  • We generally do not require a child’s full date of birth. Where relevant, we may ask for year level or age-range rather than exact birthdate.
  • If you choose to enter personal details into notes, plans, or drafts, you are choosing what you include.

5. Privacy, no advertising sales, and limited sharing

  • No selling to advertisers. We do not sell your personal information or share it with advertisers.
  • Service providers only. We may share limited information with trusted service providers who help us run the platform (for example, hosting, payments, email delivery), but only to provide and improve the service and only under confidentiality and security obligations.
  • Legal requirements. We may disclose information if required by law, court order, or to protect rights, safety, and prevent fraud.

6. data retention and deletion

  • We keep personal information only as long as needed to provide the service and to meet our legal and accounting obligations (including tax and business record requirements), resolve disputes, and enforce agreements.
  • When we no longer need it, we take reasonable steps to securely delete or de-identify it.

7. fees, billing and payments

  • Prices are shown on the website and are in AUD unless stated otherwise.
  • Payments are processed through our payment provider. We do not store full payment card details.
  • If you are on a subscription, you authorise us to charge the subscription fee on a recurring basis until you cancel.

8. refunds and cancellation (simple rules)

This section is intended to be clear and fair. It operates alongside your rights under the Australian Consumer Law.

8.1 CHANGE OF MIND

  • Digital products and immediate-access services: If you receive access immediately (for example, templates, downloads, or instant platform access), we may not offer refunds for change of mind once access is provided, unless we state otherwise on the checkout page.
  • Subscriptions: You can cancel anytime (see How to cancel a subscription). We generally do not provide refunds for the portion of a subscription period already used unless required by law or stated otherwise.

8.2 Faults and consumer guarantees (Australia)

Nothing in these Terms excludes the consumer guarantees under the Australian Consumer Law. If there is a major failure with a service, you may be entitled to a refund or other remedies. If the failure is not major, you may be entitled to have the service fixed within a reasonable time.

If you believe a charge is incorrect, please contact us first so we can try to resolve it quickly. Unresolved chargebacks can result in account suspension until the matter is resolved.

9. acceptable use

You agree not to:

  • use Apply-ED for unlawful purposes
  • attempt to access or disrupt our systems (hacking, scraping, probing, malware)
  • upload content you do not have the right to use
  • impersonate others or misrepresent your identity
  • use the service to harass, abuse, or harm anyone

We may suspend or terminate access if we reasonably believe you have breached these Terms.

10. your content and our content

10.1 your content

You own the content you enter into Apply-ED. You grant us a limited licence to host, process, and display it to provide the service (including generating drafts based on your inputs).

10.2 our content

We own (or license) the platform, templates, and other materials we provide. You may use what we provide for your personal home education planning and application preparation. You must not resell or publish our materials unless we give written permission.

11. AI-assisted features (if applicable)

If we offer AI-assisted drafting or suggestions:

  • Outputs may be incorrect or incomplete
  • You must verify outputs against current requirements and your circumstances.
  • Do not rely on outputs as professional advice.

12. service availability and changes

We try to keep the service available, but we do not guarantee uninterrupted access. We may update or change features over time. If a change materially reduces paid functionality, we will take reasonable steps to notify you.

13. limitation of liability (important)

To the extent permitted by law:

  • We are not liable for indirect or consequential loss (for example, loss of profit, loss of opportunity, or reputational loss).
  • Our total liability for a claim relating to the service is limited to the amount you paid us for the relevant service in the 3 months before the event giving rise to the claim, or (if you paid nothing) AUD $100.

This section does not limit liability where it cannot legally be limited, including under the Australian Consumer Law.

14. termination

You may stop using the service at any time. We may suspend or terminate your access if you breach these Terms or if we must do so to comply with law or protect the platform and users.

15. complaints and disputes

If there’s a problem, contact us at support@apply-ed.com.au with details. We’ll try to resolve it reasonably and promptly. If we can’t resolve it, either party may pursue formal dispute resolution options available under Australian law.

16. governing law

These Terms are governed by the laws of the relevant State/Territory in Australia. Courts in that jurisdiction have non-exclusive jurisdiction.

17. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, via email or on-site notice). Continued use after changes take effect means you accept the updated Terms.
